Can You Airbnb a Condo in Bangkok? What the Rules Say

Updated October 2026.

Many buyers ask whether they can rent their Bangkok condo on Airbnb. The short answer: daily and weekly rentals in ordinary condos are restricted, and the risks usually outweigh the extra income. Here is how the rules work and what to do instead.

What Thai law says

Renting rooms to guests for short stays is treated as running a hotel under Thailand's Hotel Act, which requires a hotel licence. Ordinary condominium buildings do not hold that licence, and Thai courts have ruled against owners who ran daily rentals in residential condos. Leases of 30 days or more are generally treated as normal residential rentals.

Building rules matter too

Most condo juristic persons prohibit short-term rentals in their regulations, and many enforce them with key-card controls, fines or by refusing access to guests. Even where the law is unclear, breaking building rules can lead to disputes with the juristic office and neighbours.

Legal options for short stays

  • Licensed condotels and serviced apartments: some projects are built and licensed to operate as hotels, so short stays are allowed. You buy a unit and the operator rents it out.

  • Monthly rentals: renting for 30 days or longer to expats, digital nomads and business travellers is a common, lower-risk strategy.

  • Long-term leases: 6- to 12-month leases give the most stable income with the least management.

Before you buy for rental income

  • Ask the juristic office for the current building regulations in writing.

  • Check whether a project marketed as a "condotel" actually holds a hotel licence.

  • Look at monthly rental demand in the area, not nightly rates.

Laws and building rules change, so confirm the current position with a lawyer before you buy. Our agents can help you compare buildings with strong monthly rental demand in areas such as Asoke and Sukhumvit.
